Return & Refund Policy

Effective Date: 25 March 2026

This Return & Refund Policy applies to all purchases made from No Fear Motocross  (“we”, “us”, “our”).

No Fear TM and the Podium Device TM are trademarks of No Fear International Limited and used under license by Tactico Industries Pty Ltd.

1. Consumer Rights (United States & California Compliance)

This policy is provided in accordance with applicable U.S. consumer protection laws, including:

  • California Consumer Legal Remedies Act
  • California Business and Professions Code §17200
  • California Civil Code §1723

Nothing in this policy limits or excludes rights that cannot be lawfully limited under applicable law.

2. All Sales Final (Limited Releases / Drops)

Due to the limited-run nature of our products:

  • All limited release / drop products are FINAL SALE
  • No returns, refunds, or exchanges unless the item is defective or incorrect

3. Standard Return Eligibility (Non-Drop Products Only)

For eligible items:

  • Return request must be made within 7 days of delivery
  • Items must be:
    • Unused, unworn, unwashed
    • In original condition
    • With all tags and packaging intact

4. Size Exchanges (Strict Policy)

For non-limited products only:

  • Size exchanges are permitted within 7 days of delivery only
  • Items must be:
    • Unworn and unused
    • In original packaging with tags

After 7 days, no exchanges will be accepted.

Customers are responsible for return shipping unless the item is defective.

5. Non-Returnable Items

The following are not eligible for return or exchange:

  • Limited release / drop products
  • Clearance or sale items
  • Custom or personalized items
  • Gift cards
  • Used or damaged items

6. Return Process

To initiate:

  1. Email: info@nofearmotocross.com
  2. Include:
    • Order number
    • Full name
    • Reason for return
    • Photos if required

Returns require prior written approval.

Unauthorized returns will be refused.

7. Return Shipping

  • Customer pays return shipping (unless defective item)
  • Shipping is non-refundable
  • Use tracked shipping

We are not responsible for lost returns.

8. Refunds

If approved:

  • Refund issued to original payment method
  • Processing time: 5–10 business days
  • Shipping costs are non-refundable

We may deduct:

  • Up to 15% restocking fee
  • Loss in value due to improper handling

9. Defective or Incorrect Items

If item is faulty or incorrect:

  • Contact within 7 days of delivery
  • Provide photos

We will:

  • Replace the item, or
  • Issue a full refund (including shipping where required)

10. Risk of Loss (Shipping Alignment)

  • Risk transfers once handed to carrier
  • Delivery times are estimates
  • Carrier delays are outside our control

11. Anti-Reseller / Bulk Purchase Policy

To protect brand integrity and distribution agreements:

We reserve the right to:

  • Refuse or cancel bulk purchases
  • Limit quantities per customer
  • Cancel orders flagged as reseller activity
  • Refuse returns linked to resale or diversion

Indicators may include:

  • Multiple large orders
  • Repeated high-volume purchases
  • Use of freight forwarders or commercial addresses

12. Chargebacks & Disputes

Customers agree to contact us first before initiating a dispute.

Improper chargebacks may result in:

  • Account suspension
  • Refusal of service
  • Legal recovery action

13. MAP & Distribution Alignment

All sales are subject to our Minimum Advertised Price (MAP) policy and distribution controls.

Unauthorized resale or price manipulation is strictly prohibited.

This policy forms part of our Terms & Conditions.
